What counts as a personal injury case in California?+

Any physical, emotional, or financial harm caused by someone else's negligence or a defective product: car, motorcycle, bicycle, rideshare, and pedestrian accidents, slip and falls, medical malpractice, and wrongful death. If another person or company caused your injury, you likely have a claim.

Is it worth hiring a personal injury lawyer?+

For anything beyond a scrape, usually yes. Insurers systematically pay unrepresented claimants less, and a lawyer's job is to know what your case is actually worth — including the non-economic damages insurers hope you'll forget. Because fees are contingency-based, representation costs nothing up front and nothing at all if you don't recover.

How do personal injury lawyers get paid?+

On contingency: the fee is a percentage of what we recover for you, agreed in writing before we start. No retainer, no hourly billing, and if we don't win, you don't owe a fee. The consultation is always free.

How long do I have to file a personal injury claim in California?+

Generally two years from the date of injury (California Code of Civil Procedure § 335.1). Claims against government entities require a claim within six months, and medical malpractice has its own rules. Evidence disappears fast — talk to a lawyer well before any deadline.

Are personal injury settlements taxable?+

Compensation for physical injuries — medical costs, pain and suffering tied to the injury — is generally not taxable under federal law (IRC § 104). Portions for punitive damages or interest can be taxed. We're not tax advisors, and we'll flag when your settlement structure deserves a CPA's review.

How are personal injury settlements calculated?+

Start with economic losses — medical bills, future care, lost income — then add non-economic damages for pain, suffering, and how the injury changed your life. Liability strength, insurance coverage limits, and venue also move the number. Beware of any adjuster's "calculator": the first offer is an opening position, not a valuation.

Does a personal injury claim include emotional distress?+

Yes. California non-economic damages cover emotional distress, anxiety, sleep loss, and loss of enjoyment of life caused by the injury. In serious cases these often exceed the medical bills.

What if I was partly at fault for the accident?+

You can still recover. California follows pure comparative negligence: your compensation is reduced by your percentage of fault, but never eliminated. Even a driver found 60% at fault can recover 40% of their damages — so don't let an adjuster talk you out of a claim.

Should I accept the insurance company's first offer?+

Almost never before you know the full extent of your injuries and future care needs. First offers are designed to close files cheaply, and once you sign a release, the claim is over — even if your condition worsens. Have a lawyer value the case first; the review is free.

How long does a personal injury case take?+

Straightforward claims can settle in a few months after treatment stabilizes. Disputed liability, serious injuries, or lowball insurers push cases into litigation, which can run a year or more. We move cases as fast as their value allows — settling early and cheap only helps the insurer.

Will my case go to court?+

Most cases settle before trial, often at mediation. But insurers track which firms actually try cases and price their offers accordingly — so we prepare every case for trial. You make the final call on any settlement.

Does California require personal injury protection (PIP) insurance?+

No. California is an at-fault state — the negligent driver's liability insurance pays. That's why uninsured/underinsured motorist (UM/UIM) coverage on your own policy matters so much here, and why we review every available policy in your case.
